Baumassurance AG is the operator of the websites baumassurance.ch. It is therefore responsible for the collection, processing and use of your personal data and the compatibility of the data processing with the applicable data protection law.

Your trust is important to us, which is why we take the issue of data protection seriously and en-sure appropriate security. We naturally comply with the legal provisions of the Federal Act on Data Protection (FADP), the Ordinance to the Federal Act on Data Protection (OFADP), the Telecommu-nications Act (TCA) and other data protection provisions of Swiss EU law that may be applicable. 1. Do we already collect data from you when you visit our site?

When you visit our website, our servers temporarily save each access in a log file. The following technical data is collected without your intervention, as is generally the case with every connection to a web server, and is stored by us until it is automatically deleted:

  • the IP address of the requesting computer,
  • the date and time of access,
  • the website from which the access was made (referrer URL), if applicable with the search term used,
  • the name and URL of the retrieved file,
  • the status code (e.g. error message),
  • the operating system of your computer,
  • the browser you use (type, version and language),
  • the amount of data transferred and
  • the transmission protocol used (e.g. HTTP/1.1).

The collection and processing of this data is carried out for the purpose of enabling the use of our website (connection establishment), to permanently guarantee system security and system stability and to enable the optimisation of our internet offer as well as for internal statistical purposes. This is our legitimate interest in processing the data.

The IP address is also evaluated together with the other data in the event of attacks on the network infrastructure or other unauthorised or abusive website use for the purpose of clarification and de-fence and, if necessary, used in the context of criminal proceedings to identify and take civil and criminal action against the users concerned. This is our legitimate interest in processing the data.

The IP addresses are stored anonymously by our host. To do this, the last one to three digits are removed, i.e. “127.0.0.1” becomes “127.0.0.0”. IPv6 addresses are also anonymised. The anony-mised IP addresses are retained for 60 days.

Error logs, which record faulty page views, are deleted after seven days. In addition to the error messages, these contain the accessing IP address and, depending on the error, the accessed website.

2. What data do we collect when you use our contact form?

You have the option of using a contact form to get in touch with us. For this purpose, we require the following mandatory information:

  • Surname, first name
  • E-mail address
  • Telephone number (optional)
  • Message text

We only use this data to be able to answer your contact request in the best possible and personal-ised way. The processing of this data is therefore in our legitimate interest.

2.a Use of Google reCAPTCHA for the contact form

This website uses the reCAPTCHA service of Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). The purpose of the query is to distinguish whether the input for forms is made by a human or by automated, machine processing. In this way, we can avoid auto-matic filling of the contact form with unsolicited messages.

The query includes the sending of the IP address and possibly further data required by Google for the reCAPTCHA service to Google. For this purpose, your input will be transmitted to Google and used there. However, your IP address will be shortened beforehand by Google within member states of the European Union or in other states party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address and other data be transferred to a Google server in the USA and shortened there. According to Google, the IP address transmitted by your browser as part of reCaptcha is not merged with other Google data. By clicking on the query, you consent to the processing of your data.

3. Communication by e-mail or telephone

If you contact us via an e-mail address or telephone number provided on the website, the collec-tion, processing and use of your voluntarily provided contact data such as title, first name, sur-name, e-mail address, telephone number and company are exclusively for a specific purpose. Ei-ther for recording and, if necessary, answering your enquiry as well as for technical administration.

Since communication by e-mail is mostly via unsecured data connection, avoid sending confiden-tial information. The e-mails received are stored in the mailboxes of the corresponding e-mail ad-dresses and in accordance with the statutory retention periods.

4. What are cookies? Do we need cookies?

Cookies help in many ways to make your visit to a website easier, more enjoyable and more mean-ingful. Cookies are information files that your web browser automatically stores on your computer’s hard drive when you visit a website. We only use

  • Technically necessary cookies
  • Cookies from Google Analytics (see paragraph 5)

This means that we currently only use technical cookies that are required for the operation of the content management system. Most internet browsers accept cookies automatically. However, you can configure your browser so that no cookies are stored on your computer, existing cookies are deleted or a message always appears when you receive a new cookie.

We use the web analytics service of Google Analytics for the purpose of demand-oriented design and continuous optimisation of our website. In this context, pseudonymised usage profiles are created and small text files stored on your computer (“cookies”) are used. The information generat-ed by the cookies about your use of this website is transmitted to the servers of the providers of these services, stored there and processed for us. In addition to the data listed in section 1, we may receive the following information:

  • Navigation path that a visitor follows on the site,
  • Dwell time on the website or subpage,
  • The subpage on which the website is left,
  • The country, region or city from where access is made,
  • End device (type, version, colour depth, resolution, width and height of the browser win-dow) and
  • Returning or new visitor.

The information is used to evaluate the use of the website, to compile reports on website activity and to provide other services related to the use of the website and the internet for the purposes of market research and the design of this website in line with requirements. This information may also be transferred to third parties if this is required by law or if third parties process this data on our behalf.

b: What is Google Analytics?

The provider of Google Analytics is Google Inc, a company of the holding company Alphabet Inc, based in the USA. Before the data is transmitted to the provider, the IP address is shortened by activating IP anonymisation (“anonymizeIP”) on this website within the member states of the Euro-pean Union or in other contracting states to the Agreement on the European Economic Area. The anonymised IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. According to Google Inc., under no circumstanc-es will the IP address be associated with other data relating to the user.

Storage and exchange of data with third parties

6. Is this data stored or linked? Who has access?

We store the data provided in sections 1-2 of this privacy policy with our hosting partner in Germany (Mittwald CM Service GmbH & Co. KG, Königsberger Straße 4-6, 32339 Espelkamp, https://www.mittwald.de/). Mittwald CM Service GmbH also has access to the data.

Likewise, our web agency (tntgraphics AG, Neue Winterthurerstr. 15, CH-8305 Dietlikon, https://www.tnt-graphics.ch/) has access to this data. The data is not linked to other services.

7. Newsletter MailerLite

You have the possibility to subscribe to our newsletter. We use this exclusively to send you the subscribed information by e-mail. For this purpose, we collect the following information using the double opt-in procedure:

  • Name
  • First name
  • E-Mail
  • Company (only for company newsletter)
  • Telephone number (voluntary)

We use the newsletter software MailerLite (MailerLite Limited, an Irish registered company at Ground Floor, 71 Lower Baggot Street, Dublin 2, D02 P593, Ireland, hereinafter “MailerLite”) to collect, store and send our newsletter. The data we transmit in MailerLite is transmitted in encrypted form and stored on MailerLite’s servers. At no time will data be passed on by MailerLite to third parties.

MailerLite offers various analysis options on how the newsletters sent are opened and used, e.g. to how many users an e-mail was sent, whether e-mails were rejected (soft and hard bounces) and whether users unsubscribed after receiving an e-mail. Based on your express consent, we will send you our newsletter on a regular basis. You can re-voke this consent at any time. You will find a corresponding unsubscribe link in every newsletter.

8. Integration of Automate.ch into our website

We have integrated a so-called iFrame integration from our partner automate.ch into the website for the calculation and conclusion of motor insurance policies. This service is completely independent of our website and data collection. When you use this service, all communication as well as any data collection and storage runs directly through automate.ch’s servers. Please also read the privacy policy of automate.ch.

9. Videos from Youtube

We use YouTube videos to make our websites more informative and interactive and to improve the user experience. These functions are offered by YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066, USA.

We have integrated YouTube videos into our online offer, which are stored on https://www.youtube.com and can be played directly from our website. These are integrated in the so-called “extended data protection mode”, i.e. no data about your user behaviour is transmit-ted to YouTube when you play the videos. However, this does not exclude the exchange of non-personal data between YouTube and your browser.

10. How long will my data be kept?

Data from the website visit is retained for a maximum of 60 days as described in section 1. If you contact us by telephone or e-mail, personal data may be collected in order to fulfil your request. We only store personal data for as long as is necessary to use the further processing within the scope of our legitimate interest.

Contract data is kept by us for a longer period of time, as this is required by statutory retention obligations. Retention obligations that oblige us to retain data arise from accounting regulations, civil law and tax law. According to these regulations, business communications, concluded con-tracts and accounting vouchers must be kept for up to 10 years. Insofar as we no longer require this data to perform the services for you, the data will be blocked. This means that the data may then only be used for accounting and tax purposes.

11. Disclosure of data to other third parties

We only pass on your personal data to other third parties if there is a legal obligation to do so or if this is necessary to enforce our rights, in particular to enforce claims arising from the contractual relationship. You have the right to request information about the personal data we hold about you. In addition, you have the right to have incorrect data corrected and the right to have your personal data delet-ed, insofar as this does not conflict with a legal obligation to retain the data or an authorisation that allows us to process the data.

You also have the right to demand that we return the data you have given us (right to data portabil-ity). Upon request, we will also share the data with a third party of your choice. You have the right to receive the data in a common file format.

15. Is your data safe with us?

We use appropriate technical and organisational security measures to protect your personal data stored with us against manipulation, partial or complete loss and against unauthorised access by third parties.

In general, you should always keep your access data confidential and close the browser window when you have finished your browsing session, especially if you share the computer, tablet or smartphone with others.

We also take internal data protection very seriously. Our employees and the service companies commissioned by us have been obliged by us to maintain confidentiality and to comply with the provisions of data protection law.

You have the right to complain to a data protection supervisory authority at any time.

17. Which law do we apply? And where is the law applied?

This privacy policy and the contracts concluded on the basis of or in connection with this privacy policy are governed by Swiss law, unless the law of another country must apply. The place of ju-risdiction is Zurich, unless another place of jurisdiction is mandatory.

18. Can this privacy policy be amended?

Should individual parts of this privacy policy be invalid, this shall not affect the validity of the rest of the privacy policy. The invalid part of the privacy policy shall be replaced in such a way that it comes as close as possible to the economically intended purpose of the invalid part.

Due to the further development of our website and offers or due to changed legal or official re-quirements, it may become necessary to change this privacy policy. The current privacy policy is published on our website.
